This English version is provided for information purposes only; the Polish-language version is the legally binding one.
1. General provisions
- These Terms of Use set out the rules for using the website operated by Xtrude3D Jakub Mazurek, with its registered office at Hajduki Nyskie 66, 48-303 Hajduki Nyskie, Poland, NIP (Polish tax identification number) 8513253087, REGON 387258247 (the “Service Provider” or the “Controller”).
- The Website presents the range of covers (enclosures) for outdoor units of air conditioners and heat pumps, and allows you to prepare a quotation request.
- You can contact the Service Provider by e-mail at: and in writing at the address of its registered office.
2. Definitions
- Website — the website operated by the Service Provider.
- User — a person using the Website.
- Configurator — the tool on the Website that allows the parameters of a cover to be selected and a quotation request to be prepared.
- Quotation Request — a message sent by the User through the form, containing the data and parameters needed to prepare a quotation.
3. Nature of the website
- In its current form, the Website is not an online shop. It has neither a basket nor online payments.
- The content presented on the Website, including descriptions, variants and visualisations, is provided for information purposes and does not constitute an offer within the meaning of the Polish Civil Code (Kodeks cywilny).
- The visualisations of completed work presented on the Website are marked as visualisations and do not depict specific installations that have been carried out.
- The final scope, price and lead time are agreed individually in response to a Quotation Request.
- The nature of the cover as a decorative element, and the rules governing responsibility for its selection and installation, are set out in section 4.
4. Nature of the cover and responsibility for its use
- The covers offered on the Website are architectural and decorative elements. Their purpose is to improve the appearance of the façade and of the surroundings of the outdoor unit. A cover does not form part of an air conditioning or heat pump installation, it is not a technical device, and it is not intended to alter the operating parameters of the appliance.
- Every appliance has its own requirements, specified by its manufacturer, as to clearances, airflow and permissible enclosure. Before ordering and installing a cover, the User must read the manual and the guidelines issued by the manufacturer and the installer of the appliance, and must make sure that the chosen cover configuration complies with them.
- The airflow assessment shown in the Configurator is calculated solely from the geometry of the cover and is intended as guidance only. It does not replace the manufacturer’s requirements or the installer’s assessment, and it does not constitute any assurance as to the operation of the appliance.
- The decision to install a cover, the choice of its configuration and the installation itself rest with the User and are carried out at the User’s own responsibility. The Service Provider is not liable for the effect of the cover on the operation, efficiency, energy consumption, service life or warranty terms of the appliance next to which it has been installed, in particular where the cover has been selected or installed otherwise than in accordance with the manufacturer’s guidelines.
- The provisions of this section do not limit the rights of a User who is a consumer arising from mandatory provisions of law, including the Service Provider’s liability for the conformity of the cover itself with the contract.
5. Rules for using the website
- The User is obliged to use the Website in accordance with the law, good practice and these Terms of Use.
- The User must not supply any content that is unlawful.
- A User who enters third-party data in the form (for example, company details) declares that they are authorised to provide it.
6. Quotation request
- In order to send a Quotation Request, the User selects the parameters of the cover in the Configurator and completes the form.
- The form covers the data necessary to make contact and prepare a quotation: first name and surname, e-mail address, telephone number and postcode, and, optionally, company name, NIP and comments.
- Sending a Quotation Request does not constitute the conclusion of a contract or the placing of an order. It is solely a request for a quotation to be prepared.
- The Service Provider prepares a response to the Quotation Request as far as possible and contacts the User in order to present the details.
- A contract may be concluded separately, once the parties have agreed the scope, price and terms of performance, in a manner agreed individually.
7. Technical requirements
To use the Website you need a device with internet access and an up-to-date web browser with JavaScript enabled. To receive a response to a Quotation Request, a working e-mail address or telephone number is required.
8. Complaints about the operation of the website
- The User may submit complaints about the functioning of the Website to the e-mail address indicated in section 1.
- A complaint should include a description of the problem and contact details.
- The Service Provider considers the complaint and informs the User how it has been dealt with at the contact address provided.
9. Intellectual property
The content published on the Website, including texts, graphics, visualisations and page layouts, is protected by law and is the property of the Service Provider or is used on the basis of the appropriate rights. Copying and distributing this content without the Service Provider’s consent is not permitted.
10. Personal data
The rules for processing Users’ personal data are described in the Privacy Policy available on the Website.
11. Final provisions
- The Service Provider may amend these Terms of Use for important reasons, in particular in connection with a change in the scope of the Website’s functionality or in the law. The current version of the Terms of Use is available on the Website.
- Matters not governed by these Terms of Use are subject to Polish law.
